Frequently asked questions
What trademark monitoring is, why you need it, and how much it will cost.
What is Trademark monitoring?
As a trademark owner, you are responsible for policing your own trademark and enforcing your own trademark rights. The easiest and most inexpensive way to stop an infringer is to catch them early, before they’re too invested in a similar brand. Our service automatically watches new trademarks filed at the trademark office for you. If something too similar to your monitored trademark is filed, one of our attorneys is notified and reaches out to you to discuss concerns and options.
Why do I need trademark monitoring?
You’re probably too busy running your business to search for new trademark applications that are filed every week. The trademark office is far from perfect and regularly approves trademarks for registration that they probably shouldn’t have. There’s an entire court, the Trademark Trial and Appeal Board, that primarily exists to litigate disputes about trademark similarity. It’s not a good idea to rely on the trademark office to protect your trademark.
What happens if there is an infringing trademark?
If you act fast, we can usually file a Letter of Protest. This is a very cost effective way to block a similar trademark from registering. We can also send out a Cease and Desist letter to the infringing party. If the infringer is stubborn, we can put you in contact with counsel who can litigate the dispute in court before the Trademark Trial and Appeal Board.
How much does an address update cost?
If we find a potential infringer, it means more business for us, so we are vigilant.
How much does trademark monitoring cost?
Trademark monitoring is a $16.95 a year for every trademark monitored.
